1. Purpose of the Clarification Text and Identity of Our Company as Data Controller

Within the scope of the Personal Data Protection Law No. 6698 (“Law”), as RentSYS (“RentSYS” and “Company”), the processing and protection of personal data in accordance with the law is among our most important priorities.

Within the framework of Article 10 entitled “Data Controller's Obligation to Inform” and Article 11 entitled “Rights of the Person Concerned” regulated in the KVKK; We present this Clarification Text (“Clarification Text”) to inform and enlighten you about the purpose for which your personal data will be processed, to whom and for what purpose your processed personal data can be transferred, the method and legal reason for collecting your personal data, and your other rights listed in Article 11 of the KVKK.

2. Purposes of Processing Personal Data

2.1 Carrying out the necessary work by the relevant units and executing the business processes in order to enable the relevant persons to benefit from the products and services offered by RentSYS:

Planning and executing the sales processes of products and/or services,
Planning and/or executing after-sales support services activities,
Planning and executing customer relationship management processes,
Following up contract processes and/or legal requests,
Following up customer requests and/or complaints.

2.2 Planning and executing RentSYS human resources policies and processes:

Planning and executing talent-career development activities,
Fulfilling the obligations arising from the employment contract and/or legislation for company employees,
Planning and executing fringe benefits and benefits for employees,
Planning and executing in-house compliance activities,
Planning and executing employee exit procedures,
Wage management,
Planning human resources processes,
Managing employee supply processes,
Planning and executing assignment-promotion and resignation processes for the company,
Planning and executing employee performance evaluation processes,
Monitoring and/or auditing employees' business activities,
Planning and/or executing in-house training activities,

2.3 Carrying out the necessary work by the relevant business units and executing the related business processes in order to carry out the commercial activities carried out by RentSYS:

Planning and executing production and/or operation processes,
Planning, auditing and executing information security processes,

2.4 Planning and executing the necessary activities to customize the products and services offered by RentSYS according to the preferences, usage habits and needs of the relevant people and to recommend and promote them:

Determining and/or evaluating the persons to be subject to marketing activities in line with consumer behavior,
Designing and/or executing personalized marketing and/or promotion activities,
Designing and/or executing advertising and/or promotion and/or marketing activities in digital and/or other media,
Designing and/or executing activities to be developed on customer acquisition and/or value creation in existing customers in digital and/or other media,
Planning and/or executing data analytics studies for marketing purposes,
Planning and executing the marketing processes of products and/or services,
Planning and/or executing the processes of creating and/or increasing loyalty to the products and/or services offered by the company.

2.5 Planning and executing RentSYS's commercial and/or business strategies:

Managing relationships with business partners.

2.6 Ensuring the legal, technical and commercial business security of RentSYS and the relevant persons in business relationship with RentSYS:

Following up legal affairs,
Planning and executing the necessary operational activities to ensure that company activities are carried out in accordance with company procedures and/or relevant legislation,
Providing information to authorized institutions arising from legislation,
Creating and following up visitor records,
Planning and executing emergency management processes,
Performing company and partnership law transactions,
Planning and executing company audit activities,
Planning and/or executing occupational health and/or safety processes,
Performing credit processes risk management,

3. Personal Data Categories

Personal data expressed as a list by RentSYS me is processed in accordance with the personal data processing conditions in the Law and related legislation:

Identity information: Information contained in documents such as driver's license, identity card, residence certificate, passport, attorney identity card, marriage certificate.
Contact information: Information used to contact the person (e.g. e-mail address, phone number, mobile phone number, address).
Location information: Information that helps to determine the location of the data subject (e.g. location information obtained during vehicle use).
Customer transaction information: Information regarding all kinds of transactions performed by customers who benefit from our products and services.
Physical space security information: Personal data regarding records and documents such as camera recordings and fingerprint records taken when entering a physical space or while staying inside the physical space.
Transaction security information: Personal data processed to ensure technical, administrative, legal and commercial security while RentSYS carries out its commercial activities.
Financial information: Personal data processed regarding information, documents and records that show all kinds of financial results created according to the type of legal relationship that RentSYS has established with the personal data owner.
Employee candidate information: Personal data processed regarding individuals who have applied to become an employee of RentSYS or who have been evaluated as employee candidates in line with human resources needs in accordance with commercial practice and honesty rules, or who are in a working relationship with RentSYS.
Legal transaction and compliance information: Personal data processed within the scope of determining, following up and fulfilling RentSYS's legal receivables and rights, as well as legal obligations and compliance with the company's policies.
Audit and inspection information: Personal data processed within the scope of RentSYS's legal obligations and compliance with company policies.
Special quality data: Data regarding people's race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, clothing, association, foundation or union membership, health, sexual life, criminal conviction and security measures, as well as biometric and genetic data.
Marketing information: Personal data processed for the purpose of customizing and marketing the products and services offered by RentSYS in line with the personal data owner's usage habits, preferences and needs, and reports and evaluations created as a result of this processing.
Request/complaint management information: Personal data regarding the receipt and evaluation of all kinds of requests or complaints directed to RentSYS.
Reputation management information: Information collected for the purpose of protecting RentSYS's commercial reputation, and information regarding evaluation reports and actions taken in this regard.
Incident management information: Personal data processed to take the necessary legal, technical and administrative measures against events that develop for the purpose of protecting RentSYS's commercial rights and interests and the rights and interests of its customers.

Principles and Conditions Regarding the Processing of Personal Data

RentSYS, in accordance with Article 4 of the Law, is engaged in personal data processing activities in a manner that is in compliance with the law and rules of honesty, accurate and up-to-date when necessary, with specific, clear and legitimate purposes, related to the purpose, limited and measured. RentSYS retains personal data for the period stipulated in the laws or required by the purpose of personal data processing.

4.1 Principles Regarding the Processing of Personal Data

RentSYS is to inform data owners in accordance with Article 10 of the KVK Law and processes these personal data by requesting their consent from data owners in cases where consent is required, based on the principles stated below.

4.1.1 Processing Data in Accordance with the Law and the Rule of Honesty: RentSYS acts in accordance with the principles introduced by legal regulations and the general trust and honesty rule in the processing of personal data. In accordance with the principle of being in accordance with the rule of honesty, RentSYS takes into account the interests and reasonable expectations of the relevant persons while trying to achieve its goals in data processing.

4.1.2 Ensuring That Personal Data is Accurate and Up-to-Date When Necessary: Keeping personal data accurate and up-to-date is necessary for RentSYS to protect the fundamental rights and freedoms of the relevant person. Ensuring that personal data is accurate and up-to-date when necessary is within RentSYS's active duty of care. For this reason, all communication channels are open for the information of the relevant person who is the data owner to be kept accurate and up-to-date by RentSYS.

4.1.3 Processing Data for Specific, Clear and Legitimate Purposes: RentSYS clearly and precisely determines the legitimate and legal personal data processing purpose. It processes as much personal data as is related to and necessary for its commercial activities.

4.1.4 That the Data is Related to, Limited and Measured with the Purposes for Which They Are Processed: RentSYS; processes personal data within the scope of the relevant subject and for the purposes necessary for the conduct of its business. For this reason, it processes personal data in a way that allows the realization of the determined purposes and avoids processing personal data that is not related to or not needed for the realization of the purpose.

4.1.5 Retention of Data for the Period Stipulated in the Relevant Legislation or Necessary for the Purpose for Which They Are Processed: RentSYS retains personal data only for the period specified in the relevant legislation or necessary for the purpose for which they are processed. In this context; firstly, it determines whether a period is foreseen for the storage of personal data in the relevant legislation, and if a period is determined, it acts in accordance with this period, and if a period is not determined, it stores personal data for the period necessary for the purpose for which they are processed. After the personal data processing purpose disappears or the period stipulated in the legislation expires, personal data is deleted, destroyed or anonymized by RentSYS.

4.2 Conditions Regarding the Processing of Personal Data

Your personal data is processed by RentSYS if at least one of the personal data processing conditions in Article 5 of the Law exists.

4.2.1 Having the explicit consent of the personal data owner
One of the conditions for processing personal data is the explicit consent of the owner. The explicit consent of the personal data owner must be specific to a specific subject, based on information and declared with free will. In order for personal data to be processed depending on the explicit consent of the personal data owner, explicit consent is obtained from customers, potential customers and visitors through relevant methods.

4.2.2 Personal data processing activities are clearly foreseen in the laws
The data owner's personal data can be processed legally without the data owner's explicit consent if it is clearly stipulated in the law.

4.2.3 Failure to obtain the person's explicit consent due to actual impossibility
The data owner's personal data can be processed if it is mandatory to process the personal data of the person who is unable to express his consent due to actual impossibility or whose consent will not be recognized, in order to protect the life or bodily integrity of himself or another person.

4.2.4 The personal data is directly related to the establishment or performance of a contract
It is possible to process personal data if it is necessary to process the personal data of the parties to the contract, provided that it is directly related to the establishment or performance of a contract.

4.2.5 RentSYS fulfills its legal obligation
The data owner's personal data can be processed if it is mandatory for RentSYS to fulfill its legal obligations as the data controller.

4.2.6 Making the data owner's personal data public
The relevant personal data can be processed if the data owner has made his personal data public himself.

4.2.7 Data processing is mandatory for the establishment or protection of a right
The data owner's personal data can be processed if data processing is mandatory for the establishment, use or protection of a right.

4.2.8 Data processing is mandatory for RentSYS's legitimate interest
The data owner's personal data can be processed if data processing is mandatory for RentSYS's legitimate interests, provided that it does not harm the fundamental rights and freedoms of the personal data owner.

4.3 Processing of Special Quality Personal Data

RentSYS acts sensitively and appropriately to the regulations stipulated in the KVK Law when processing personal data determined as “special quality” by the KVK Law. By RentSYS; Special quality personal data is processed in the following cases, provided that sufficient measures to be determined by the KVK Board are taken:

If the personal data owner has explicit consent or
If the personal data owner does not have explicit consent;
- Special quality personal data other than the personal data owner's health and sexual life, in cases stipulated in the laws,
- The personal data owner's special quality personal data regarding health and sexual life is processed only by persons or authorized institutions and organizations under the obligation of confidentiality, for the purpose of protecting public health, preventive medicine, medical diagnosis, treatment and care services, planning and management of health services and financing.

5. Transfer of Your Personal Data

RentSYS can transfer the personal data and special quality personal data of the data owner to third parties at home or abroad by taking the necessary security measures in line with legal personal data processing purposes. In this direction, RentSYS acts in accordance with the regulations stipulated in Article 8 of the KVK Law.

Your personal data;

To lawyers, auditors, tax advisors and other third parties from whom we receive consultancy and services; in order to carry out our business processes in accordance with the law and our legitimate interests, to exercise our right of defense in a possible judicial process,
To your proxies and representatives authorized by you; in order to fulfill our legal obligations,
To regulatory and supervisory institutions and other official institutions such as courts and enforcement directorates and other public institutions or organizations authorized to request your personal data; in order to fulfill our legal obligations,
To our business partners and performance assistants from whom we receive services, in order to improve our services and improve infrastructure and security processes, within the framework of personal data processing conditions and purposes specified in Articles 8 and 9 of the KVKK.

6. Rights of the Data Owner and Exercise of Related Rights

6.1 Rights of the personal data owner:

To learn whether their personal data is processed,
If personal data has been processed, to request information regarding this,
To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
To know the third parties to whom personal data is transferred at home or abroad,
To request correction of personal data if it is incomplete or incorrectly processed, and to request that the transaction made in this context be notified to third parties to whom personal data is transferred,
To request the deletion or destruction of personal data in the event that the reasons requiring its processing disappear, even though it has been processed in accordance with the provisions of the KVK Law and other relevant laws, and to request that the transaction made in this context be notified to third parties to whom personal data is transferred,
To object to this result if a result arises against the person himself by analyzing the processed data exclusively through automated systems,
To demand compensation for the damage in case of damage due to unlawful processing of personal data.

If personal data is not obtained directly from the data owner;

By RentSYS,

Within a reasonable period of time from the date of obtaining personal data,
If personal data will be used for the purpose of communication with data owners,
During the first contact,
If personal data will be transferred, activities are carried out to inform data owners at the latest when personal data is transferred for the first time.

In accordance with Article 28.2 of the KVK Law; In the following cases, personal data owners cannot assert their other rights listed in 5.1, except for the right to demand compensation for damages:

Personal data processing is necessary for the prevention of crime or criminal investigation,
Processing of personal data made public by the personal data owner himself,
Personal data processing is necessary for the performance of supervision or regulation duties and disciplinary investigation or prosecution by authorized and competent public institutions and organizations and professional organizations in the nature of public institutions, based on the authority granted by law,
Personal data processing is necessary for the protection of the economic and financial interests of the State in relation to budget, tax and financial matters.

7. Deletion, Destruction, Anonymization of Personal Data

As regulated in Article 138 of the Turkish Penal Code and Article 7 of the KVK Law, personal data is deleted, destroyed or anonymized based on RentSYS's decision or upon the request of the personal data owner, in the event that the reasons requiring its processing disappear, even though it has been processed in accordance with the relevant legal provisions. In this context, RentSYS has taken the necessary technical and administrative measures within the company to fulfill its relevant obligation; It has developed the necessary operating mechanisms in this regard; It trains, assigns and raises awareness of the relevant business units in order to comply with these obligations.
